NxShift Privacy Statement

1. Who we are

NxShift is the point-of-sale, booking, and business platform operated by NxThing ("NxThing", "we", "us"), based in Orange County, California, United States. This Statement explains how we collect, use, disclose, and protect personal information across NxShift and related NxThing products (together, the "Services").

2. Information we collect

From customers of a business using NxShift

• Name, email address, and mobile phone number
• Order, booking, and payment history (we do not store full card numbers — payments are processed by our payment processors)
• Approximate location, only when you order at a table via QR and only with your consent
• Your NxThing-ID profile, favorites, and preferences

From businesses (merchants) and staff

• Business name, address, contact details, and tax/EIN information you provide
• Staff accounts, roles, and login credentials (passwords are stored only as salted hashes)
• Menu, inventory, calendar, and transaction data you enter into the Services

3. How we use information

• To process orders, bookings, payments, and send receipts and reminders
• To operate, secure, and improve the Services
• To provide support and communicate with you about your account
• To comply with legal, tax, and accounting obligations

4. How we share information

We share personal information only with: (a) the business you transacted with; (b) service providers acting on our behalf (payment processing, email/SMS delivery, hosting) under contract; and (c) authorities when required by law. We do not sell or rent your personal information.

5. Your California privacy rights (CCPA/CPRA)

• The right to know what personal information we collect, use, and disclose
• The right to access and to delete your personal information
• The right to correct inaccurate personal information
• The right to opt out of the "sale" or "sharing" of personal information — we do not sell or share it for cross-context behavioral advertising
• The right not to be discriminated against for exercising your rights

6. SMS messaging (TCPA)

We send SMS only where you have actively opted in. Message and data rates may apply. Reply STOP to unsubscribe at any time, or HELP for help. Consent to receive SMS is not a condition of purchase.

7. Email (CAN-SPAM)

Every marketing email includes an unsubscribe link. Transactional messages (receipts, booking confirmations) are sent as part of the Service.

8. Data retention & security

We retain personal information for as long as needed to provide the Services and meet legal obligations, then delete or de-identify it. We use industry-standard technical and organizational safeguards; no method of transmission or storage is 100% secure.

9. Children

The Services are not directed to children under 13, and we do not knowingly collect their personal information.
